Welcome to Pokehype SA, operated by ALCHEMY AGENCY COLLECTIVE (PTY) LTD ("Pokehype SA", "we", "our", "us", or the "Promoter").
Pokehype SA offers a South African online skill-based promotional competition platform where participants ("Participant", "you", or "your") may enter Ball Drop competitions for the opportunity to win Pokémon-related products and collectibles, including but not limited to Pokémon cards, booster packs, Elite Trainer Boxes (ETBs), sealed products, trading card collectibles, and related merchandise ("Prizes").
The Pokehype SA Ball Drop competition is a skill-based prediction game in which Participants attempt to predict the final landing coordinates of a digital ball as it travels through a pachinko-style "Mystery Zone". The winner is determined by the Participant whose selected coordinates are closest to the verified final landing coordinates.
By accessing or using this Website and participating in any competition hosted by Pokehype SA, you agree to be legally bound by these Terms & Conditions ("Terms"), including any Privacy Policy and additional competition-specific rules published on the Website. If you do not agree to these Terms, you must immediately stop using the Website and Services.
For purposes of these Terms: • "Competition" refers to any Ball Drop skill-based promotional competition hosted by Pokehype SA. • "Competition Period" means the duration during which entries for a specific Competition are open. • "Entry" means a valid purchased or promotional ticket submitted into a Competition. • "Mystery Zone" refers to the digital play area where the final landing coordinates of the Ball are determined. • "True Coordinates" refers to the verified final landing coordinates determined and revealed by the Promoter. • "Website" means www.pokehype.co.za
Participants must satisfy all of the following requirements: • Be 18 years of age or older at the time of entry. • Be a legal resident of South Africa. • Possess a valid South African ID document or passport. • Use a valid South African delivery address for prize fulfilment. The following persons are prohibited from participating: • Employees or contractors of ALCHEMY AGENCY COLLECTIVE (PTY) LTD. • Immediate family members of employees or contractors. • Any person directly involved in the operation, administration, judging, or development of the Competition. • Any person attempting to manipulate or abuse the platform. The Promoter reserves the right to request proof of eligibility at any time.
The Pokehype SA Ball Drop Competition is a skill-based promotional competition. Success is determined by a Participant's ability to predict the trajectory and final landing position of the Ball within the Mystery Zone. Winners are selected based on the closest coordinates submitted relative to the verified True Coordinates. The Competition is not random chance-based gambling, betting, or wagering. All Competitions are governed by the laws of South Africa.
To enter a Competition, Participants may be required to create an account on the Website. Participants agree that: • All information submitted must be accurate and truthful. • Only one account per individual is permitted. • Multiple accounts created to bypass entry restrictions are strictly prohibited. • Accounts may not be shared, transferred, or sold. Pokehype SA reserves the right to suspend or terminate accounts suspected of abuse, fraud, or manipulation.
Participants may enter a Competition by: • Purchasing an Entry ticket through the Website; or • Receiving an approved promotional free entry where applicable. Each Entry allows the Participant to select coordinates predicting where the Ball will land within the Mystery Zone. The Promoter reserves the right to determine: • Entry pricing; • Competition durations; • Prize allocations; • Entry limitations; • Promotional offers. All entry purchases are final and non-refundable except where required by law.
Pokehype SA may offer one (1) free entry per Participant per month for selected low-tier Competitions. Free entries: • Are limited to one per verified user; • May not be transferred or sold; • Do not guarantee eligibility if abuse is detected. The Promoter reserves the right to withdraw or amend free entry promotions at any time.
The Ball Drop Competition operates as follows: • Participants select coordinates predicting where the Ball will ultimately land. • The Ball travels through a pachinko-style Mystery Zone containing obstacles and directional changes. • At the conclusion of the Competition Period, the verified True Coordinates will be determined and publicly revealed by the Promoter via official Pokehype SA social media channels. • The winner will be the Participant whose submitted coordinates are closest to the True Coordinates. Distance between entries and the True Coordinates will be calculated mathematically using straight-line coordinate distance.
If two or more Participants submit entries equally close to the True Coordinates: 1. Additional entries submitted by tied Participants may be compared based on proximity rankings. 2. If still tied, the Promoter may: • Conduct an additional review process; • Initiate a sudden-death Ball Drop round; • Or apply another fair skill-based resolution method. The Promoter's decision shall be final.
Winners may be announced: • On the Website; • Via email; • Through official Pokehype SA social media channels. Participants agree that their first name, social handle, city, and prize details may be publicly displayed for promotional purposes.
Before any Prize is shipped, Winners may be required to provide: • Valid South African identification; • Proof of residency; • Proof of account ownership; • Shipping details. Failure to provide requested information within seven (7) days may result in disqualification and redraw of the Prize.
By accepting a Prize, Winners agree to provide: • A photograph/selfie with the Prize upon receipt; and • Permission for Pokehype SA to use such images for promotional and marketing purposes. This includes use across: • Social media; • Website content; • Advertising materials; • Promotional campaigns. Participants who refuse to comply may forfeit eligibility for future Competitions.
Prizes may include but are not limited to: • Pokémon booster packs; • Elite Trainer Boxes (ETBs); • Sealed Pokémon products; • Trading cards; • Collectibles; • Accessories; • Other related merchandise. Prizes are: • Non-transferable; • Non-exchangeable; • Not redeemable for cash. If a Winner declines a Prize, the Prize may be redrawn at the Promoter's discretion. If a listed Prize becomes unavailable, the Promoter reserves the right to substitute it with a Prize of equal or greater value. All prizes are shipped within South Africa only.
Pokehype SA will make reasonable efforts to dispatch prizes within a reasonable timeframe after verification. The Promoter is not responsible for: • Courier delays; • Lost parcels caused by incorrect addresses; • Damage occurring after confirmed delivery; • Customs or regional delivery restrictions. Risk transfers to the Winner upon confirmed delivery.
The following conduct is strictly prohibited: • Use of bots, scripts, automation, or artificial systems; • Coordinated manipulation of entries; • Scalping or resale abuse; • Multiple-account abuse; • Chargeback fraud; • Exploitation of technical vulnerabilities. Pokehype SA reserves the right to: • Void entries; • Suspend accounts; • Permanently ban users; • Cancel prizes; • Pursue legal action where necessary.
Pokehype SA and ALCHEMY AGENCY COLLECTIVE (PTY) LTD are not affiliated with, endorsed by, sponsored by, or associated with: • Nintendo; • The Pokémon Company; • Game Freak; • Creatures Inc.; • Or any related rights holders. All trademarks, logos, and intellectual property remain the property of their respective owners. Products offered as prizes are lawfully acquired retail products used within a promotional competition format.
To the fullest extent permitted by South African law: • Participation is entirely at the Participant's own risk. • The Promoter shall not be liable for any indirect, incidental, consequential, or economic losses. • The Promoter makes no warranties regarding uninterrupted Website access or technical functionality. • The Promoter is not liable for technical failures, outages, server issues, payment interruptions, or internet disruptions. Participants indemnify the Promoter against claims arising from misuse of the platform or breach of these Terms.
Participants consent to receiving communications electronically, including: • Competition notices; • Winner announcements; • Verification requests; • Marketing communications where consent is provided. Participants may unsubscribe from marketing communications at any time.
Personal information collected by Pokehype SA will be processed in accordance with applicable South African privacy laws, including POPIA. Information collected may include: • Name; • Email address; • Delivery information; • Contact details; • Competition participation data. Personal information will only be used for legitimate operational and promotional purposes.
All decisions made by the Promoter regarding: • Competition outcomes; • Winner verification; • Eligibility; • Disqualification; • Prize allocation; shall be final and binding. The Promoter reserves the right to correct administrative or technical errors where necessary.
Pokehype SA reserves the right to: • Amend these Terms; • Cancel or suspend Competitions; • Modify Competition mechanics; • Refuse participation; at any time and without prior notice where reasonably necessary. Continued use of the Website constitutes acceptance of updated Terms.
These Terms shall be governed by the laws of South Africa. Any disputes arising from these Terms shall fall under the exclusive jurisdiction of the South African courts.

Pokehype SA and ALCHEMY AGENCY COLLECTIVE (PTY) LTD shall not be held liable for any delay, suspension, interruption, or failure to perform any obligation under these Terms where such delay or failure results from events beyond reasonable control, including but not limited to: • Natural disasters; • Power outages; • Internet or telecommunications failures; • Cyber attacks; • Government actions or restrictions; • Civil unrest; • Pandemic-related disruptions; • Courier or logistics interruptions; • Supplier shortages. In such circumstances, the Promoter reserves the right to suspend, extend, modify, or cancel any Competition where reasonably necessary.
All payments made through the Website are processed through third-party payment providers. By submitting payment information, Participants confirm that: • They are authorized to use the payment method provided; • All payment information supplied is accurate and lawful; • They will not initiate fraudulent chargebacks or payment disputes. Pokehype SA reserves the right to suspend accounts and void entries associated with suspicious or disputed transactions.
Except where required under applicable South African consumer protection laws: • Competition entries are non-refundable; • Entries may not be exchanged or transferred; • Missed or unused entries remain the responsibility of the Participant. If a Competition is cancelled by the Promoter prior to completion, Participants may receive replacement entries, store credit, or another remedy determined by the Promoter.
Competitions hosted by Pokehype SA may be promoted through social media platforms including Instagram, Facebook, TikTok, YouTube, and X (Twitter). By participating, Participants acknowledge that: • Social media platforms are not sponsors, administrators, or affiliates of the Competition; • Participants release such platforms from any responsibility related to the Competition. Any public comments, harassment, abuse, or manipulation directed at staff, Participants, or the Competition may result in immediate disqualification and account suspension.
Participants agree not to: • Abuse or harass other users; • Post defamatory or offensive content; • Attempt to manipulate public results or announcements; • Impersonate other individuals; • Damage the reputation of the Promoter through fraudulent conduct. Pokehype SA reserves the right to remove users or restrict platform access where community standards are violated.
If any provision of these Terms is found to be unlawful, invalid, or unenforceable by a court of competent jurisdiction, that provision shall be severed from the remaining Terms, which shall remain fully valid and enforceable.
These Terms constitute the full agreement between the Participant and ALCHEMY AGENCY COLLECTIVE (PTY) LTD regarding the use of the Website and participation in any Competition. These Terms supersede any prior agreements, communications, or understandings relating to the Competition platform.
By using the Website, purchasing entries, submitting predictions, or participating in any Pokehype SA Competition, you acknowledge that you have: • Read these Terms & Conditions; • Understood these Terms & Conditions; • Agreed to be legally bound by these Terms & Conditions.
